Cerebral Palsy in Infants: Exploring Legal Options for Birth Injury Cases

Many individuals are unfamiliar with cerebral palsy as they have never encountered anyone with this disorder. However, it is one of the most common birth injuries today and will impact the child’s muscle tone, movement, and motor skills as they develop. Cerebral palsy in infants occurs when there are complications during the pregnancy, labor,  or when the child is delivered. Parents need to understand what causes this neurological disorder and what legal options are open to them to help them provide and care for this child as they grow.

Complications of Cerebral Palsy

A child with cerebral palsy may have difficulty moving and maintaining balance and posture. This disorder arises when the child’s brain does not develop properly or is damaged during the birth process. The severity of this condition varies,  with some children experiencing mild impairment and others being severely disabled. Parents should consider hiring a lawyer if a doctor determines their child has this disorder.

Symptoms vary significantly by individual. Some children have trouble with motor skills, and others have stiff or floppy muscles. Poor coordination is common in these children, who may involuntarily move. The symptoms often interfere with their ability to walk, talk, eat, or complete other daily activities. Cerebral palsy will stay with the child for life. However, with early intervention and therapy, the child’s quality of life can often be improved. Medical professionals are of great help in ensuring each child gets the care they need based on the symptoms they are experiencing.

Cerebral Palsy Causes

Cerebral palsy may result from abnormal brain development., such as a mutation or other natural cause. However, many cases occur as medical professionals make mistakes during pregnancy, labor, or delivery. What are some common causes of this disorder?

Hypoxia, or a lack of oxygen, is a common cause of cerebral palsy. The child does not receive enough oxygen during birth. Three causes of hypoxia are a compressed umbilical cord, a prolapsed cord, or fetal distress during labor. When this oxygen deprivation is prolonged, brain damage often occurs, and the child is diagnosed with cerebral palsy.

Traumatic birth injuries may also contribute to the development of cerebral palsy. The doctor may use forceps or a vacuum extractor to remove the child, or they may use excessive force. When a breach birth or shoulder dystocia is not handled correctly,  the child may develop cerebral palsy period.

During pregnancy, the mother may contract an infection that can damage the developing fetus. Rubella, toxoplasmosis, and cytomegalovirus are three infections that can cause this damage. The newborn may also contract an illness like meningitis, which can lead to cerebral palsy if not treated immediately. However, some cases are the result of medical negligence.

Doctors may not monitor the baby properly to ensure they are receiving enough oxygen, they may delay a c-section, or they may not use delivery instruments properly. Every medical professional must provide a standard of care to ensure that the mother and baby both make it safely through labor and delivery. When a doctor breaches this duty and the child develops cerebral palsy, they should be held accountable.

Parents must recognize the signs of cerebral palsy and seek help immediately if they suspect their child has this condition. They need an experienced attorney with knowledge of medical malpractice suits to help them seek compensation for the care their child will need now and in the future. This attorney will provide them with guidance and support as they seek justice for their infant.
